Greener v. Shell
is a national disability civil rights class action lawsuit. The parties to the suit have voluntarily signed a consent decree that will guarantee compliance with the Americans with Disabilities Act for persons with mobility disabilities at 3,840 Shell stations in 1,768 cities across the United States. The decree covers more facilities of a single company than does any other reported ADA settlement signed since the passage of the ADA eight years ago. Listed here are some of the highlights.
- The Decree covers 3,840 stations that are owned, operated and/or leased by defendants Shell Oil Company, Shell Oil Product Company and Equilon Enterprises LLC.
- Shell will survey 3,621 stations
built before January 1993 to determine where disability access modifications are needed. The survey will be conducted using a negotiated 10-page survey form. Surveys began in January 1999 and will continue through 2001.
- Shell will modify older stations when a survey identifies problems with disability access. Areas of older stations subject to modifications will include convenience stores, customer restrooms, parking areas, telephones, cashier windows, and paths of travel. Modifications will be made over a 42-month period beginning nine months after the first surveys are completed.
- All stations constructed since January 1993 will comply with applicable ADA architectural standards.
All future alterations will comply with applicable ADA architectural standards. All stations that become Shell stations over the next five years will be subject to the terms of the agreement. Pump handles and self-service card readers in fuel dispensers at all new and substantially altered stations will be accessible.
- Shell will issue policies and guidelines to guarantee non- discriminatory service to persons with disabilities.
Signs will be posted regarding the service, and Shell will publicize an 800 number for customer comments. Shell will provide refueling service to persons with disabilities at self-service prices as required by the ADA whenever two or more appropriate persons are on duty.- Shell will train various personnel to ensure non-discriminatory service to persons with disabilities and will provide important accessibility information to independent business persons who operate many Shell stations.
- Key structural elements such as accessible parking spaces, doors to convenience stores and paths to customer restrooms will no longer be obstructed by
product displays and other impediments that often prevent access to wheelchair riders and other persons with mobility disabilities.

WITH RESPECT TO SHELL-BRANDED FACILITIES

REFUELING AND PUMP ACTIVATION AT SELF-SERVICE PRICES
:Vehicle refueling service and pump activation service will be provided upon request at self-service prices to motorists with disabilities if the vehicle displays an official or locally issued disabled motorist plate or placard.
WHEN REFUELING SERVICE IS TO BE PROVIDED
:At full service stations, the refueling service for persons with disabilities will be provided during full service hours and, if applicable, at other times as described in this guideline. During non-full service hours at full service stations and at stations with no full service hours, the refueling service for persons with disabilities will be provided when there are two or more appropriate employees who are on duty unless legitimate safety requirements (including crime prevention measures) preclude such service.
WHEN PUMP ACTIVATION SERVICE IS TO BE PROVIDED
:In addition to the services described above, and upon request of a person with a disability, any person staffing a cash register at self service stations and at full service stations during non-full service hours, will activate fuel dispensing equipment that would otherwise be activated by use of a self-service card reader provided that the fuel dispenser can be activated from an area at or nearby the cash register and is not already activated.
SERVICE IN OBTAINING GOODS FOR PURCHASE
:Upon reasonable request, assistance in obtaining goods for purchase will be provided to customers with disabilities unless legitimate safety requirements (including crime prevention measures) preclude such service.
SIGNS SPECIFYING SERVICE
:Each station will post a readily observable sign which specifies the refueling and pump activation services to be provided. The sign will also specify the method by which a motorist with a disability can indicate a request for refueling and/or pump activation service if applicable. The sign will contain the international symbol of accessibility.
